The Plant Breeders’ Rights Act is a special form of copyright law that gives the breeder of a plant variety the right to commercially exploit the variety they have created.
Breeders of new varieties can apply for protection at the Federal Plant Variety Office in Germany on the basis of the Plant Breeders’ Rights Act. Protection can also be applied for at the Community Plant Variety Office (CPVO), the European Union agency responsible for implementing a system for the protection of new plant varieties.
Plant breeders’ rights are valid for 25 years, or 30 years for hops, potatoes, vines and trees.
